Matjinda Katjiua and OTA application dismissed

The urgent application by Matjinda Katjiua and the Ovaherero Traditional Authority (OTA) was dismissed in the Windhoek High Court by Judge Herman Oosthuizen this afternoon. Katjiua, in his urgent application, wanted the chairperson of the OvaHerero Traditional Authority, Chief Vipuira Kapuuo, as the first respondent, not to act as if he is representing OTA or its paramount chief and also not to interfere with the bank account of the authority at Standard Bank. The Minister of Urban and Rural Development and Standard Bank were cited as second and third respondents respectively. Kapuuo opposed the application or denied its urgency in his answering affidavit and questioned Katjiua’s authority to bring the application. Katjiua admitted in his application that he was still to be recognised by the government in terms of the Traditional Authorities Act. Judge Oosthuizen dismissed the application with costs because Katjiua lacked locus standi nor established clear right to bring such as application, as he is not a recognised chief, under the Traditional Authorities Act, which sets out recognition of traditional chiefs. Katjiua has been ordered to pay the costs of Kapuuo, including for one instructing and two instructed attorneys.
