Representatives from both, the Namibia Premier League and the Normalization Committee, were satisfied with the arguments presented to the Supreme Court today by their respective lawyers in the NPL Jurisdiction Appeal Case. The Supreme Court has reserved judgment on the matter for a date still to be confirmed by the three judges, who heard the case on Thursday. The Namibia Premier League appealed the High Court Decision's to strike the matter off the court role on the basis of jurisdiction to hear the case. This is because the NFA statues refer an aggrieved member to approach the Court of Arbitration for Sport in Switzerland. As such, the NPL now wants the Supreme court to set aside the high court decision not to hear the case. They were represented by Advocate William Mokhare from South Africa instructed by Werner, Kauta and Hoveka law firm. NPL Chairperson Patrick Kauta said he was satisfied with their argument as put forward by their lawyer. “The matter was well argued. We told the court that the Court of Arbitration for Sport don't hear the matters which are final, because our suspension by the NC is not final. It is provisional that's why we could not go to CAS” Kauta said. On his part Sisa Namandje representing the Normalization Committee asked for the appeal to be struck from the roll by the supreme court as he concurred with the high court's decision. Normalisation Committee Vice Chairperson Franco Cosmos was also content with how their representative argued the case. “I think it is up to the court to decide on what will happen next. The congress will go ahead and the court might change some of the requirements to the congress, but I don't think the Congress will be postponed” Cosmos said. After almost three hours of arguments, Judge of Appeal Justice Hoff, Justice Smuts and Acting Judge of Appeal Justice Frank reserved their judgment to no later than the 22nd of this month, which is the date set for the NFA congress.
