
Former Justice Minister Sacky Shanghala, along with two co-accused in the "Fishrot scandal," is determined to have Judge Moses Chinhengo removed from presiding over their case.
Their application challenging the constitutionality of Chinhengo's appointment as Acting Judge of the High Court is set to be heard in the coming days by Deputy Judge President Hannelie Prinsloo.
Shanghala, James Hatuikulipi, and Pius Mwatelulo have filed a request in the High Court to review and set aside Chinhengo’s appointment.
The trio argues that non-Namibian judges, referred to as "peregrini," can only serve on a single fixed-term contract, asserting that Chinhengo’s appointment in April 2023 was ultra vires—meaning "beyond legal authority"—and unconstitutional.
Their application names the President of Namibia, the Judicial Service Commission, the Judge-President, and the Minister of Justice, among others, as respondents.
The applicants contend that all rulings and decisions made by Chinhengo as an acting judge should be declared null and void.
