The High Court is expected to deliver a ruling today on whether nine charges against Fishrot accused Nigel van Wyk will be dropped.
Van Wyk has submitted a review application, arguing that the charges against him are baseless. He maintains that when former Justice Minister Sackey Shanghala allegedly devised a plan to defraud the fishing industry, he neither knew Shanghala personally nor worked for him.
He further contends that the State has failed to produce any witnesses linking him to the alleged scheme, either in its planning or implementation.
Van Wyk spent four years in custody before being granted bail of N$20,000 by Judge David Munsu. In his ruling, Munsu noted that the available evidence suggested Van Wyk was merely an employee of Oleya Investments and not a key figure in the alleged corruption.
Munsu added that the time Van Wyk has already spent behind bars could exceed any sentence he might receive if convicted.
