Defence lawyer Sisa Namandje concluded his case in the bail application of Malakia Elindi, his wife Lydia, and brother Peter Elindi, who are accused of fraud, money laundering, and other charges in connection with the NAMCOR fuel supply deal. 

Former Namcor Managing Director Immanuel Mulunga, who is also implicated, is expected to take the stand tomorrow morning.

The State alleges that Malakia Elindi, through Enercon, submitted incorrect banking details to the Ministry of Defence, which led to the payment of over N$30 million. 

Part of the funds are alleged to have been channelled to companies linked to the Elindis, including Onyeka Clearing and Forwarding CC.

Lydia Elindi confirmed in court that she owns 50 percent shares in Onyeka. 

While she admitted to being a signatory to Onyeka's bank accounts, she told the court that she does not participate in the daily operations of the businesses. 

Her husband also maintained that she had no operational role.

The State claims Onyeka fraudulently benefited from payments made by Enercon, and that funds were redirected to Eco Trading, which then paid Onyeka. 

During testimony, the Elindi brothers said Onyeka was paid to clear goods ordered from outside Namibia.

Namandje criticised the State for submitting tax invoices during the bail hearing only after he had completed his examination of Malakia Elindi, accusing the prosecution of doing so intentionally. Prosecutor Menencia Hinda denied this. 

Lydia Elindi also told the court she was not informed of the charges at the time of her arrest. 

However, Prosecutor Hinda rejected the claim, stating that she was informed both at her residence in Kleine Kuppe and again at the Klein Windhoek police station.

Malakia Elindi said he acted lawfully when he signed the agreement transferring the rights to supply fuel to NAMCOR and argued that the State is repeating questions without presenting sufficient evidence to support its case.

The bail hearing will continue tomorrow morning.
