High Court Acting Judge Moses Chinhengo has reserved his decision on a preliminary point raised by the state, which seeks a three-month delay in the Fishrot trial.
The state’s request comes in light of a separate application brought before the High Court by Sacky Shanghala and other accused, challenging the constitutionality of former President Hage Geingob's appointment of Judge Chinhengo.
According to the state, it would be prudent to suspend the proceedings, including the pending application for the separation of trials, until the High Court delivers its ruling on this constitutional challenge, as the outcome could directly impact the current trial.
Shanghala did not oppose the state’s request for a delay.
Judge Chinhengo indicated that he would issue his ruling on the matter on Monday, November 18, 2024.
