The three Swapo Party representatives in the ||Kharas Regional Council filed an urgent High Court interdict on Friday, seeking a reversal of the council's decision to terminate their memberships.

The three—Lazarus Nangolo, Taimi Amakali, and Suzan Ndjaleka—were relieved from council duties because they absconded from meetings and refused to accept vacant council management committee positions.

The respondents listed in the notice of motion to the High Court are the ||Kharas Regional Council and its chairperson, Joseph Isaack, Acting Council CRO Benedictus Diergaardt, Landless People's Movement (LPM), Electoral Commission of Namibia (ECN), and President Hage Geingob as respondents.

The respondents were given until February 2nd to indicate any intention to oppose.

In court papers filed on Friday, applicants Nangolo, Amakali, Ndjaleka, and Swapo Party called on the court to review, correct, and set aside the council's decision on the grounds that it was unlawful and invalid, and to reinstate the affected councillors.

The applicants further call for the special meeting that terminated their membership to be declared invalid and unlawful, along with a decision by Isaack to extend Diergaardt's appointment as acting Chief Regional Officer.

Additionally, the suspended councillors are asking the court to declare unlawful the council's failure to inform ||Kharas Governor Aletha Frederick of the special meeting.

To that effect, they want the court to grant an interim order, allowing them to carry out their duties until the finalisation of the court application.

The court papers reveal that the applicants also ask for a cost order against the council and Isaack.
