An attempt to compel the Electoral Commission of Namibia (ECN) to accept a revised list of the Christian Democratic Voice (CDV) party candidates for the National Assembly election has failed.
On Monday, the Windhoek High Court struck off the case, which was brought forward by a faction led by Viola Garises.
Acting Judge Kobus Müller ruled that most of the 37 respondents had not been formally notified of the application.
The Judge said that the case, concerning the party’s candidate list for the upcoming November 27 election, is an electoral matter that should be addressed by the Electoral Court rather than the High Court.
Garises has also been ordered to pay the legal costs of the CDV founder and president, Gothard Kandume, and the ECN.
