Lawyers representing former NAMCOR Managing Director Immanuel Mulunga and Finance Executive Jennifer Hamukwaya told the court that, while their clients may have breached company policies, they did not commit any criminal offence.

The bail hearing, in which eight accused seek their release, entered week three today.

During their bail application, lawyer Francois Bangamwabo said the Anti-Corruption Commission was using NAMCOR's internal affairs to target his clients and is confusing debt collection with corruption. 

He said Hamukwaya acted lawfully and on instructions from the managing director.

ACC chief investigator Oberty Inambao testified that some accused in the case compromised investigations by contacting each other during their arrests. 

He said the ACC confiscated mobile devices after observing that Mulunga called his co-accused, Cedric Willemse, during his arrest. 

Inambao said fugitive accused Victor Malima may have been alerted by other co-accused.

Bangamwabo argued that the seizure of his clients' devices was unlawful and that any evidence from them would be inadmissible. 

Inambao said the Anti-Corruption Commission Act permits seizure of property under certain circumstances.
