Security company G4S says that even if it is found responsible for the theft of diamonds from NAMDIA, any payout would be limited to just N$4,200.

NAMDIA filed a lawsuit against G4S following the theft of diamonds valued at over N$300 million, during which the security firm was in charge of the premises' guarding. 

The state-owned company claims that a security guard, Sammuel Shipanga, who was on duty at the time, was involved in the robbery. He has since been arrested and charged with numerous offences.

In court papers filed in the High Court, G4S denies it is liable for the loss. 

The company says its security agreements with NAMDIA include clauses that limit how much it can be required to pay, and those clauses still apply.

G4S further argues that NAMDIA cannot now ignore those terms, saying the relationship between the two companies was always governed by the security agreements, which include the limits on liability.

The security firm also states that NAMDIA did not give it notice of the claim before taking the matter to court.

G4S is asking the court to dismiss the claim with costs, or alternatively, it wants the court to rule that any compensation payable cannot exceed N$4,200.
