The Chief Executive Officer of the Roads Authority says two former executives, Sidney Boois and Richard Milinga, who took the company to court, are trying to create urgency where there is none.

In papers filed in the High Court, CEO Hippy Tjivikua opposes the application of Boois and Milinga, who want to be reinstated.

Tjivikua says the two were dismissed in February after being found guilty of misconduct and that they are already going through an internal appeal process.

He says the appeal hearing held on 16 March was arranged within the required time and that a chairperson to head the appeal hearing was appointed by extending an existing contract to avoid delays.

Boois and Milinga claim the hearing was not fair, but Tjivikua says the two waited before going to court, which shows there was no real urgency.

He also says the case should have been taken to the labour authorities instead of the main court.

Tjivikua adds that the process inside the Roads Authority is still ongoing, with the next step set for May, and that there is no immediate harm to the applicants.

He opposes their request for reinstatement, saying such matters should be handled through labour processes.

The Roads Authority is asking the court to remove the case from the urgent roll or dismiss it with costs.
