High Court to pronounce itself on Fishrot challenge

The Windhoek High Court is poised to announce its judgement today in response to a challenge by the Fishrot accused.

 

James Hatuikulipi, former Justice Minister Sacky Shanghala, and two of their co-accused want High Court Judge Kobus Miller removed from the bench, citing his age.

 

They assert that President Hage Geingob contravened Article 82 of the Namibian Constitution when he confirmed Justice Miller’s appointment.

 

This article dictates that acting judges must not surpass the age of 70 at the time of their appointment to the bench.

Same-sex marriage judgement referred to Swapo Central Committee

The Swapo Party Politburo has decided to refer the recent judgement of the Supreme Court on same-sex marriage to the Central Committee for further deliberation and decision-making.

The Swapo Party acknowledged the significance of the matter and assured Namibians that it would approach the issue with the utmost seriousness and consideration.

Xinfeng Investment judgement postponed

Judge Ramon Maasdorp has postponed the judgement in the case of Xinfeng Investment - a Chinese lithium miner whose mining license was revoked by the Ministry of Mines and Energy.  

The judgment has been set for next week Friday.

The Ministry of Mines and Energy's Acting Executive Director, Bryan Eiseb explained that they had revoked the license after Xinfeng was found to have deliberately filed incorrect information during the application process and that the company failed to adequately explain the misleading information.

No end to BoN, Trustco tussle

The fight between Trustco and the Bank of Namibia is far from over, as the two were again involved in a tit-for-tat this week, with a judgement against the central bank and a fresh application by the latter to have Trustco Bank liquidated.

The Bank of Namibia made a fresh application to the High Court that Trustco Bank be liquidated on November 2, and a day later, on November 3, a client of Trustco won an application in the High Court preventing and stopping the central bank from its intentions to take steps against the private bank.
