NEFF's Michael Amushelelo and AR's Dimbulukeni Nauyoma denied bail

NEFF's Michael Amushelelo and AR's Dimbulukeni Nauyoma have been denied bail. Windhoek Regional Magistrate Masule Kwezi ruled that the State has proven on a balance of probability that the applicants are not suitable candidates for bail. Kwezi says an individual's freedom is a fundamental right that should not be suspended unless it prejudices the hands of justice. Kwezi added the principle of presumption of innocence is a consideration, however, the charges against the applicants are of a serious nature and considering the two have pending cases of which they are out on bail, the court is thus of the view that the accused may commit further crimes. The court could not find further appropriate conditions to impose if bail is granted, and therefore the accused are remanded in custody pending their trial on the 5th of July. The two, with six others, were arrested one week ago on charges of public violence at China Town in Windhoek when they staged a protest against the Chinese being allowed to sell counterfeit goods. The other six were released on warning the same day of their arrest, and lawyers questioned the move to detain only the two as an unfair application of the law.
