High Court Judge Shafimana Ueitele has delayed and suspended the execution of the Supreme Court order for Menzies Aviation to vacate the Hosea Kutako International Airport.

Menzies had the tender for ground handling services at the airport, which has since been awarded to Paragon.

The Supreme Court ordered Menzies to vacate the Hosea Kutako International Airport (HKIA) after it approached the court, appealing against the decision of the Namibia Airports Company to grant the airport tender to Paragon.

The ground handling service provider had lost its case in the Supreme Court and was ordered to vacate the airport to pave the way for Paragon and Ethiopian Airlines to resume their services.

The Namibia Airports Company has given Menzies three days to leave its premises for Paragon to take over.

Menzies, for its part, approached the High Court to determine if the three-day notice was fair, rational, and just.

The company also sought that the three-day order be suspended or delayed.

Judge Uitele found that Menzie's conduct did not constitute abuse of the court process, as Lawyer Sisa Namandje for Paragon argued.

Namandje submitted that the order of the Supreme Court should be binding and final in terms of the Supreme Rules.

He further argued that the order sought by Menzies to either stay or delay is incompetent and therefore should not be granted.

Judge Ueitele dismissed all arguments presented by Namandje and postponed the matter to July 4 for both parties to deliver their affidavits.
