State Advocate Lilungwe Basson, this morning, told the Windhoek High Court that the State is not ready to proceed with the appeal of the bail application by Peter and Malakia Elindi and former Namcor executives Immanuel Mulunga, Jennifer Hamukwaya, Olivia Dunaiski, and Leo Nandago.
The Namcor corruption accused are appealing against the denial of bail by lower court Magistrate Linus Samanzula.
Most of the legal representatives, including the State, did not file their required legal paperwork on time or procedurally.
High Court Judge Philinda Christiaan directed all parties to file the required documents procedurally within five days.
All answering affidavits and supporting documents must be filed on or before 3 February.
The court gave the parties an option on when the matter will be heard: either 12 and 13 February or 20 and 21 February.
Lawyer Sisa Namandje informed the court that his clients, who initiated the appeal, would be disappointed that the matter could not continue as planned today and suggested 12 and 13 February.
Boris Isaacks, while agreeing with 12 and 13 February, expressed concern that the two days might not be enough; the court said it would discuss and inform the parties of a possible extension.
Judge Christiaan also mandated a one-hour time slot for each party to address the court.
The appeal for bail will now be heard on 12 and 13 February.
