Fishrot accused to plea with or without legal representation

Judge Moses Chinhengo has ruled that the Fishrot accused will proceed with the plea-taking, even in the absence of Bernhardt Esau's lawyer, Florian Beukes, who is on medical leave until December 22.

Despite the defense's concerns raised by lawyer Mbanga Siyomunji that his decision could be prejudicial, Chinhengo affirmed the decision, maintaining that the plea-taking will move forward.

It was a busy day in the Windhoek High Court as one of the Fishrot accused, Sacky Shanghala, suffered another blow.

Application to remove acting High Court Judge Kobus Miller scrapped

The Windhoek High Court has struck from the roll an application brought forward by four Fishrot accused, whose application sought to remove acting High Court Judge Kobus Miller from practicing as a judge.

The accused individuals had attempted in the past to have Judge Miller recuse himself, alleging bias.

However, their initial request was denied by Judge Miller, and their subsequent appeal suffered a setback in the Supreme Court.

GUSTAVO BEHIND BARS

Ricardo Gustavo has complied with the Supreme Court order and handed himself over to the Windhoek Correctional Facility just minutes before the given deadline of 17:00.

Deputy Commissioner General of the Namibian Correctional Services, Sam Shalulange confirmed that Gustavo was accompanied by his close family members.

Gustavo who was granted bail in December last year December has been ordered by the Supreme Court to report to the Windhoek prison by 17:00 today.

Supreme Court Reserves Judgment

The Supreme Court has reserved judgment in a case in which the state is appealing the granting of bail to one of the Fishrot accused, Ricardo Gustavo.

High Court Judge Herman Oosthuizen granted Gustavo N$800,000 bail.

The Prosecutor General argues that the High Court narrowly interpreted the notions of public interest and justice when it granted bail to Gustavo.
