The Windhoek High Court has provisionally withdrawn a case in which the members of Heaven Ark Housing are demanding their land and credentials back, which were allegedly taken by the developer Stefan Malan.

The withdrawal of the case has left the group in dismay.

The High Court indicated that the provisional withdrawal of the case was due to the death of the initial complainant and that new instructions had been given to obtain alternative statements.

Heaven Ark Housing Representative James Links stated that there are over a thousand members who bought plots from the City of Windhoek to build houses.

They were allocated a nine-hectare piece of land to construct apartment units and stand-alone houses.

Links said they worked with Stefan Malan for five years as a developer and investor until he allegedly transferred the land ownership to his name.

Links said they disagreed with continuing with the development of the remaining portion of land after filling two portions.

The Prosecutor General has also yet to make a decision on the matter.

The court further ordered the reimbursement of N$50,000 in bail to the depositor.
