RedForce Debt Management has filed an urgent application with the Windhoek High Court to prevent the Henties Bay Municipality from terminating its debt recovery contract.

In court documents, RedForce claims that the cancellation has caused the company severe and irreparable harm. They are seeking an order to suspend the termination until a full review can be conducted.

The company argues that the termination notices issued in September and October are invalid, insisting that it has complied with all contractual terms and has not breached the agreement. RedForce requests the court to declare the termination letters null and void, emphasizing the sudden nature of the cancellation, which took them by surprise.

The Henties Bay Municipality, however, justifies the termination by pointing to a rise in municipal debt from N$52 million to N$62 million since the contract began. The municipality accuses RedForce of improperly claiming payments and highlights that the bid was signed outside the validity period. They argue that continuing the contract would not serve the public's best interest.

High Court Judge George Coleman will hear the case.
