The Supreme Court has unanimously dismissed Dr. Panduleni Itula's application to set aside the 2024 Presidential elections.
In delivering the ruling, Chief Justice Peter Shivute stated that the Electoral Commission of Namibia (ECN) acted correctly in recommending an extension of voting for the presidential election.
Justice Shivute clarified that the extension did not constitute the creation of new elections or polling stations.
Shivute further noted that no irregularities or challenges were recorded in the occurrence books across various polling stations.
He said that it was impractical for the ECN to predict voter turnout at specific stations and provide the exact number of required ballots, as the law allows Namibians to vote at any polling station during national elections.
The court also ruled that a nationwide extension of voting was not feasible and that limiting the extension to 36 polling stations was not inherently discriminatory.
The Electoral Court will soon hear the merits in which IPC and the LPM are seeking to nullify the National Assembly elections of 2024.
That court put the matter on hold until the Supreme Court finalises the presidential challenge.
