The Ministry of Works and Transport has issued a directive requiring that traffic citations related to vehicle defects and non-compliance be issued to the registered vehicle operators rather than the drivers.
Veikko Nekundi made the announcement in the National Assembly on Tuesday, following concerns raised by the public, transport associations, and truck drivers.
The complaints centered on drivers being fined for mechanical failures and vehicle defects that fall under the responsibility of transport operators.
"The directive, effective from 9 June 2025, instructs traffic enforcement officers to issue citations for vehicle defects to the registered vehicle operators."
Align enforcement practices with the legal distinction between driver and operator responsibilities. Apply the directive consistently across all regions. Drivers should not be penalised for vehicle defects they cannot control. Responsibility lies with those who maintain and operate the vehicles. This directive ensures that enforcement aligns with the law and promotes accountability. Section 64 of the Road Traffic and Transport Act assigns responsibility for vehicle maintenance, loading, documentation, and roadworthiness to vehicle operators, not drivers.
