The Elindi brothers, who have been arrested and accused in the alleged NAMCOR multi-million dollar corruption scandal, have approached the High Court to have their bail denial by Magistrate Linus Samunzala set aside.
Peter and Malakia Elindi face charges of fraud and corruption involving an alleged amount exceeding N$400 million.
In their appeal, the brothers argue that the Magistrate erred in his decision. The appeal states that Samunzala found no evidence that the brothers were flight risks or would interfere with investigations, yet still denied bail.
The Elindis maintain that the ruling failed to assess disputed issues properly, including the amount involved, the strength of the state’s case, and public interest concerns. They also challenge the finding that their evidence was contradictory, arguing the court unfairly dismissed their testimony while favouring that of the investigating officer, even though he conceded the accused were unlikely to abscond or interfere.
Represented by Sisa Namandje, the brothers now ask the High Court to overturn the decision and grant each of them bail of N$50,000.
