Prosecutor General Martha Imalwa has yet to file a plea and counterclaim in the case in which marijuana activists Brain Jaftha and Borro Ndungulu want the government to legalise the use of cannabis in Namibia.

High Court Judge Eileen Rakow has postponed the matter to August 1st.

Jaftha and Ndungulu are demanding that the legislative prohibition of the possession and use of cannabis by adults be declared inconsistent with the Constitution.

They also want, within 6 months of the granting of an order, should the Court rule in their favour, that all citizens presently incarcerated for the use or possession of cannabis be released from prison and that all sentences for which charges relate to the possession of dagga be reduced by the prison term required to be served for the dagga conviction.

Court documents, however, indicate that two years after the case was lodged, the Prosecutor General has yet to file a plea and counterclaim.

In court documents, Jaftha and Ndungulu claim that they have not been informed by the defendants on whether they have obtained any recommendations from the LRDC and how they intend to proceed with the matter.

Judge Rakow has given the PG until July 4 to file her counterclaim and plea, if any.
