A panel of Supreme Court judges, including Chief Justice Peter Shivute, Deputy Chief Justice Petrus Damaseb, and Justices of Appeal Sylvester Mainga, Hosea Angula, and Dave Smuts, will hear the case in which Dr. Panduleni Itula is challenging the results of the 2024 Presidential Election.

The hearing is scheduled for February 10 and 11, 2025.

Dr. Itula is asking the court to nullify the election results, arguing that the Electoral Commission of Namibia (ECN) unlawfully extended voting beyond the official election date, through a presidential proclamation.

Voting continued on November 29 and 30, which he claimed was unconstitutional and violated the Electoral Act.

He is seeking a declaration that the entire election process was invalid and an order for a new presidential election.

The case is opposed by the President, Attorney General, ECN, Chief Electoral Officer, President-elect, and the Swapo Party, who argue that the election was fair and lawful.

They contend that Dr. Itula has not provided evidence that the extended voting period affected the outcome and that he failed to file complaints through the correct legal process before approaching the court.

The Landless People’s Movement (LPM) and its leader, Bernadus Swartbooi, have applied to join the case as co-applicants, supporting Dr. Itula’s challenge.

They also want the Supreme Court to declare the extension of voting unlawful and either invalidate ballots cast after November 27 or order a fresh election.

However, the President and other respondents argue that LPM and Swartbooi’s application is procedurally flawed, as they did not initially oppose the election results and are now trying to join the case late.
